Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the AppeneriX platform and the website at appenerix.com (together, the “Service”), provided by Appixio Inc. (“Appixio,” “we,” “us”). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Accounts
You must provide accurate information when creating an account and are responsible for keeping your credentials secure and for all activity under your account. You must be at least 16 years old (or the age of majority in your jurisdiction) to use the Service.
2. Plans, free tier, and billing
The Service offers a free tier and paid plans. The free tier is available as described on our pricing page. Paid plans are billed in advance on a recurring basis; fees are non-refundable except where required by law. We may change plan features or pricing on a going-forward basis with reasonable notice.
3. Your content
You retain all rights to the files and data you upload and the apps you build (“Your Content”). You grant us a limited license to host, process, and display Your Content solely to operate and provide the Service to you. You are responsible for Your Content and for having the necessary rights to use it.
4. Acceptable use
You agree not to:
- Break the law or infringe others’ rights using the Service.
- Upload malware or attempt to disrupt, probe, or circumvent the security of the Service.
- Reverse engineer or copy the Service except as permitted by law.
- Use the Service to send spam or store or transmit unlawful, harmful, or infringing content.
- Exceed rate limits or abuse public preview tools.
5. Our intellectual property
The Service, including its software, design, and the AppeneriX and Appixio marks, is owned by Appixio and its licensors and is protected by intellectual property laws. These Terms do not grant you any right to our trademarks or branding.
6. Third-party services
The Service may integrate with or link to third-party services (for example, analytics, security, and video providers). Your use of those services is governed by their own terms, and we are not responsible for them.
7. Beta features
We may offer features identified as beta, preview, or experimental (for example, the PowerApps converter). Beta features are provided “as is,” may change or be discontinued, and may not work as intended. Use them at your own discretion.
8. Suspension and termination
You may stop using the Service at any time. We may suspend or terminate access if you violate these Terms, if required by law, or to protect the Service or other users. On termination, your right to use the Service ends; we may delete Your Content after a reasonable period unless retention is legally required.
9. Disclaimers
The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.
10. Limitation of liability
To the maximum extent permitted by law, Appixio will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data. Our total liability for any claim relating to the Service will not exceed the amount you paid us for the Service in the 12 months before the claim, or USD 100 if you use the free tier.
11. Indemnification
You agree to indemnify and hold Appixio harmless from claims arising out of Your Content, your use of the Service, or your violation of these Terms, to the extent permitted by law.
12. Governing law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-laws rules. The courts located in Ontario will have exclusive jurisdiction, except where mandatory local law provides otherwise.
13. Changes to these terms
We may update these Terms from time to time. When we do, we will revise the “Last updated” date and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect constitutes acceptance.
